Introduction

NYC BigApps 2013 Competition (the “Competition”) is a joint initiative of New York City Economic Development Corporation and the New York City Department of Information Technology & Telecommunications (the “Sponsors”). The Competition is intended to provide recognition to individuals, teams of individuals, corporations and nonprofit originations (collectively, “Contestants”) for developing innovative software applications that utilize City of New York (“City”) data set(s) available on NYC Open Data at www.nyc.gov/data (“City Data”); utilize other approved data set(s)/ Application Programming Interfaces (“APIs”) listed on the Competition website at www.nycbigapps.com/datasets (“Approved Data”); and/or that generate new, high-quality data set(s) relevant to New York City (“Generated Data”). The goals of the Competition are threefold: (1) to stimulate the development of applications that improve access to information and government transparency, making it easier and more fun to visit, live and work in the City; (2) to encourage innovation and the creation of new intellectual property with commercial potential by individuals, startups and small organizations; and (3) to help leverage technology to solve select City challenges and problems (“BigIssues”).

Summary* of How to Enter and Judging Criteria

  1. Create a working Software Application (the “Application” or “App”) that meets one or more of the below requirements:

    • uses at least one City of New York (“City”) data set available on the NYC Open Data platform at www.nyc.gov/data (“City Data”);

    • uses at least one data set or API officially listed on the Competition website at www.nycbigapps.com/datasets (“Approved Data”); or

    • generates at least one new, high-quality data set relevant to New York City (“Generated Data”).

    Collectively, all City Data, Approved Data, and Generated Data constitute eligible data sets (“Official Data”) for use in the competition.

  2. Visit NYCBigApps.com to create an account and submit a Project Page of your Application including a link to your Application, a video of your Application, a text description of your Application, at least one photograph of your working Application, and a list of all City Data, Approved Data or Generated Data used in/created by the Application (collectively, the “Submission”).

Submissions (excluding the Best Jobs and Economic Mobility Apps - First, Second, and Third Prizes) will be judged on the following four criteria: (1) potential impact on New York City residents, visitors and businesses, as relevant to each respective BigIssue or Wildcard category; (2) implementation of the idea (including user experience and design); (3) quality of the idea (including creativity and originality); and (4) potential commercial viability. Best Jobs and Economic Mobility Apps - First, Second and Third Prizes will be judged by the above criteria, excluding potential commercial viability.

1. Can I Participate?

The Competition is open only to: 1) individuals that are 14 or older that are legally residing in the fifty (50) United States (including the District of Columbia); and 2) corporations or organizations that are domiciled in the United States, incorporated at the time of entry and employ fewer than twenty five (25) people at the time of entry. Individuals submitting on behalf of teams, corporations and nonprofit organizations must meet the eligibility requirements for individual Contestants. An individual may join more than one team, corporation or nonprofit organization.

Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees of Sponsors, employees of CollabFinder Inc., Competition judges, and Competition advisors, and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible.

Employees of the City of New York who do not work for the Sponsors; retailers or distributors of Sponsors or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Competition, and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee must make the Sponsors and CollabFinder Inc. aware of any conflict of interests between themselves, the Sponsors, the judges, BigIssue partners, event partners, and data partners before posting a Submission.

Minors must identify themselves upon sign-up and will require parental or legal guardian consent to participate.

Individuals and Companies cannot post a Submission that has been publicly available for more than one year as of the Competition start date.

Companies with more than twenty five (25) full-time employees as of the Competition start date cannot participate in the competition or post a Submission on behalf of their company.

The Competition is subject to all applicable United States federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor's and Administrator’s decisions, which are final and binding on all matters related to the Competition. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. When Do I Enter?

Between March 19, 2013 at approximately 9:00 PM Eastern Daylight Time (“EDT”) and June 7, 2013 at 5:00 PM EST (the “Competition Submission Period”). Administrator’s computer is the official timekeeping device for this Competition.

3. How Do I Enter?

A. Register:

During the Competition Submission Period, register at NYCBigApps.com. Registration is free. Registration requires that you have a personal Facebook account. Registrants cannot use a company, group, or any other kind of Facebook account to register, although individuals may represent organizations participating in the Competition. Registered Contestants must create a free profile on CollabFinder.com, the software platform that is powering the NYCBigApps website. Instructions for how to register and create a free profile are listed on NYCBigApps.com. Registered Contestants will then be able to create Project Page(s) and enter Submission(s). In the event of a dispute as to any registration, the authorized Facebook account holder used to register will be deemed to be the Contestant. The “authorized account holder” is the natural person assigned a personal account by Facebook.com. Potential winners may be required to show proof of being the authorized account holder. Contestants must comply with the terms of use of data sets listed by Sponsors. Failure to do so could result in disqualification from the Competition at the Sponsors’ sole discretion.

B. Online Requirements:

Each Contestant will be required to provide the following as part of the Submission:

  • A link to the Application.

  • A video of the Application.

  • A text description of the Application.

  • At least one photograph of the working software Application.

  • A listing of all City Data, Approved Data or Generated Data used in/created by the Application.

After the Competition Submission Period has ended, the Submission cannot be modified in any way until after Judging has ended.

C. Category Requirements:

You will also be required to check off which competition categories, if any, your Submission is being submitted for.

You may enter your Submission into multiple competition categories but cannot win more than one category, plus the NYC BigApps 2013 Grand Prize. In the event your Submission wins two or more categories, the Sponsor will select an odd number of judges to vote on which category your Submission wins. Only first place Submissions in the Jobs and Economic Mobility; Healthy Living; Cleanweb: Energy, Environment, and Resilience; and Lifelong Learning categories, collectively the “BigIssue Categories,” are eligible to win the NYC BigApps 2013 Grand Prize.

Administrator reserves the right to add or remove a Submission from a specific category if the Submission does not meet the relevant requirements. The following is a short description of each of the award category requirements:

The judges will select one Grand Prize winner from the pool of winning apps in the BigIssue Categories. Judges will select the Grand Prize Application based on its commercial viability, potential impact on New York City residents, visitors and businesses, quality of implementation, and quality of idea.

Jobs and Economic Mobility - First Prize App

The judges will select the Jobs and Economic Mobility- First Prize Application based on its ability to help New York City’s underserved residents find gainful employment, develop workforce skills, and/or access worker support services (e.g child care, healthcare support, education, affordable housing, etc.).

Jobs and Economic Mobility - Second Prize App

The judges will select the Jobs and Economic Mobility - Second Prize Application based on its ability to help New York City’s underserved residents find gainful employment, develop workforce skills, and/or access worker support services (e.g child care, healthcare support, education, affordable housing, etc.).

Jobs and Economic Mobility - Third Prize App

The judges will select the Jobs and Economic Mobility- Third Prize Application based on its ability to help New York City’s underserved residents find gainful employment, develop workforce skills, and/or access worker support services (e.g child care, healthcare support, education, affordable housing, etc.).

Best Healthy Living App

The judges will select the Best Healthy Living Application based on its ability to help New York City residents, visitors, and businesses live healthier lifestyles (e.g., fitness, nutrition), enhance health education and understanding of health trends, and/or improve access to healthcare resources.

Best Cleanweb: Energy, Environment, and Resilience App

The judges will select the Best Cleanweb: Energy, Environment, and Resilience Application based on its ability to help solve critical resource and resilience challenges affecting New York City.

Best Healthy Living App

The judges will select the Best Healthy Living Application based on its ability to help New York City residents, visitors, and businesses live healthier lifestyles (e.g., fitness, nutrition), enhance health education and understanding of health trends, and/or improve access to healthcare resources.

Best Cleanweb: Energy, Environment, and Resilience App

The judges will select the Best Cleanweb: Energy, Environment, and Resilience Application based on its ability to help solve critical resource and resilience challenges affecting New York City.

Best Lifelong Learning App

The judges will select the Best Lifelong Learning Application based on its ability to help people of all ages to connect to New York City’s diverse learning opportunities and educational resources outside of K-12 public schools.

Best Wildcard App

The judges will select the Best Wildcard Application based on its commercial viability, potential impact on New York City residents, visitors and businesses, quality of implementation, and quality of idea.

D. Submission requirements for each category are as follows:

Submission must be a software application that meet one or more of the following data requirements: uses at least one City of New York (“City”) data set available on the NYC Open Data platform at www.nyc.gov/data (“City Data”); uses at least one data set or API officially listed on the Competition website at www.nycbigapps.com/datasets (“Approved Data”); and/or generates at least one new, high-quality data set relevant to New York City (“Generated Data”). There may be limited changes (updating or refreshing) to the City Data or Approved Data, and new eligible data sets or APIs may be added after the Competition launch. Please check NYCBigApps.com/datasets frequently for updates.

  2. Submissions may combine Official Data with other non-official data, provided the Contestant is authorized to distribute the non-official data through a free, publicly available application.

  3. Generated Data must provide a significant benefit to New York City residents, businesses, visitors, and/or government. Generated Data may include, but is not limited to the following: 1) original data that is collected directly through the Application’s user input or behavior, 2) original data that is collected by the Application’s creator(s) from direct observation, including through the use of scientific equipment and sensors, and/or 3) original data that is collected by the Application’s creator(s) from direct calculation or computation. Application creator(s) may not pay any individual or organization to gather or submit data. Data-gathering and data quality-control techniques must be fully disclosed on the Submission’s Project Page. The Sponsors and Administrator reserve the right to assess and verify the accuracy, reliability, and/or validity of any Generated Data.

  4. Submissions may be any kind of software application, be it for the web, a personal computer, a mobile handheld device, SMS, or any software platform broadly available to the public.

  5. Submissions must contain an application that functions as expressed in the text description.

  6. Submissions must be made available to the public for free for at least one year after Competition end date.

  7. Submissions must not be substantially similar to prior Submissions already submitted in this Competition or the NYC BigApps Competitions that commenced on October 6, 2009 or October 12, 2010 or October 11, 2011. Submissions to the NYC BigApps Competition that commenced on October 6, 2009 can be viewed at: http://2009.nycbigapps.com/submissions. Submissions to the NYC BigApps Competition that commenced on October 12, 2010 can be viewed at: http://2010.NYCBigApps.com/submissions. Submissions to the NYC BigApps Competition that commenced on October 11, 2011 can be viewed at http://2011.NYCBigApps.com/submissions.

  8. Submissions cannot include Applications that won the NYC Schools Gap App Challenge (http://nycschools.challengepost.com/) or the MTA App Quest (http://mtaappquest.com/).

  9. Submissions must be either in English or if in a language other than English, must be accompanied by an English translation of the text.

  10. Submissions must not be indecent, defamatory, in obvious bad taste, demonstrate a lack of respect for public morals or conduct or adversely affects the reputation of the Sponsors.

  11. Submissions must not: a) be illegal under applicable laws; b) depict hatred, defame, threaten a specific community in the society or incite violence; c) contain vulgar language or violence; or d) contain pornography, obscenity or sexual activity.

  12. Submissions must a) be original; b) be solely owned by Contestant and that no other party has any rights or interest, whether known or unknown; and c) not violate the Intellectual Property, common law or privacy rights of other parties. A Contestant may contract with a third party to assist with the creation of their Submission, provided the Contestant is the sole and unequivocal owner of all intellectual property and licenses in the Submission.

E. Submission Rights for Entrants:

Contestants will own the intellectual property rights to their Submission but the City, Sponsors and Administrator will maintain a royalty free license to, without limitation: a) Post the Submissions on NYCBigApps.com; b) Make the Submissions available for the course of the Competition and 12 months after the conclusion of the Competition Submission Period; and c) Utilize the Submissions for noncommercial purposes for a period of 12 months after the conclusion of the Competition Submission Period.

4. Display of Submissions

Submissions will be posted on NYCBigApps.com. Submissions are expected to have been tested for basic functionality, accuracy of messaging, and integrity (i.e., security). The Administrator has the right to request access to the Application in person or via any reasonable manner to verify that the Application functions and operates as stated in the Submission. Failure by a Contestant to honor such a request will result in the Submission’s immediate disqualification. All Contestants will have the same ability to view Submissions posted on the website. Non-Contestants interested in the Competition are also encouraged to subscribe to competition updates at NYCBigApps.com.

5. Public Feedback

The Sponsors will actively solicit and encourage public feedback for all Submissions throughout the Competition period. Contestants are expected to make good faith efforts to read and consider public feedback and to respond to it when appropriate.

6. Winner Selection and Judging Criteria

Submissions will initially be screened by a qualified internal panel selected by the Sponsors at their sole discretion. The internal panel will consist of employees of the Sponsors and Administrator. The internal panel will judge the Submissions on the criteria identified below to select finalists. Then the finalists will be judged again on the criteria identified below by an expert judging panel determined by the Sponsors. The external panel will be identified on NYCBigApps.com.

Sponsors reserve the right to substitute or modify the judging panel at any time for any reason. Judges do have the right to withdrawal without advance notice in the event of extenuating circumstances beyond their control. Judges will be fair and impartial. A judge may elect to recuse him or herself from judging a Submission, if in the judge’s sole discretion it is not appropriate for him or her to judge that particular Submission because of a past or current relationship with that particular Contestant. A Submission will not be at a disadvantage if one or more judge recuses himself or herself.

Submissions may only win in one category, plus the NYC BigApps 2013 Grand Prize. Only winners of the best Applications within their respective BigIssue Categories are eligible to win the NYC BigApps 2013 Grand Prize.

Odds of winning depend on the number of eligible Submissions received and the quality of the Submissions. The approximate dates for the judging panel are between June 10, 2013 at 10:00 AM EST and June 20, 2013 at 5:00 PM EST.

The one (1) Contestant, in each category listed above whose Submission earns the highest overall score will win the prizes identified below in section 8. In the event of a tie, the winner will be selected based on the criteria described in (1), then (2), then (3), and finally (4), if applicable.

7. Verification of Potential Winners

ALL POTENTIAL COMPETITION WINNERS ARE SUBJECT TO VERIFICATION BY SPONSORS AND/OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE COMPETITION. Potential winners must continue to comply with all terms and conditions of these Official Rules. The potential winners will be notified on or about June 27, 2013. The potential winners will be required to sign and return to Sponsors and Administrator, within ten (10) business days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable.

If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of a Competition prize is disqualified for any reason, Sponsors may award the applicable prize to an alternate winner who had the highest score remaining of the eligible entries. If a winner is considered to be a minor in his or her state of residence, at Sponsors’ sole option, the prize will either be awarded to the minor winner’s parent or legal guardian on behalf of the winner, or the minor’s parent or guardian will be required to ratify and sign the affidavit of eligibility, and liability/publicity release.

For all Prizes: Winners are responsible for all taxes and fees associated with prize receipt and/or use. Sponsors reserve the right to substitute prizes of comparable value. No transfer or substitution of a prize is permitted except by Sponsors. The prize check will be mailed to the winner’s address or wired to the winner’s bank account within 60 days of receipt of the signed affidavit(s) of eligibility and liability/publicity release(s) form(s). If a team of individuals, a company or an organization is selected as a prize winner, the prize will be awarded to the group and it will be up to the group, company or organization to split or appropriately allocate the prize. No single Contestant or individual can win more than 2 prizes.

9. Founders’ Network Participation and Jobs and Economic Mobility Application Follow-on Funding

All winners are eligible to participate in the NYC BigApps Founders’ Network.

The Founders’ Network is an exclusive association providing startup business support for NYC BigApps winners for twelve (12) months following the Competition’s end. The Founders’ Network will include the following:

  • Three networking events for Founders Network members to meet with investors, industry experts, talent, the press and other winners.

  • Three workshops led by industry experts to help each individual or team (topics to be published in July 2013) launch startup companies.

  • Access to office hours with New York City-based advisors that may include investors, mentors and industry experts.

  • Access to additional resources that may include subsidized office space, pro bono legal advice, and more.

All Jobs and Economic Mobility Application winners are expected to further improve and develop their app for at least one year post-Competition, in exchange for additional cash payments up to $20,000 for meeting development milestones.

Additional cash payments are not guaranteed and will be distributed only if Jobs and Economic Mobility Application winners meet the milestones set out for them by Sponsors and Administrator including, but not limited to:

  • Creation of maintenance and development milestones, timelines, objectives and goals;

  • monthly reporting of development progress to Sponsors and Administrator;

  • development of user feedback functionality;

  • development of a website to promote the winning Application; and

  • development and implementation of a marketing strategy, goals and metrics.

Jobs and Economic Mobility Application winners can also elect to pass responsibility and payment for follow-on maintenance and development requirements to a willing and interested nonprofit organization, community benefit organization (CBO), corporation, or other qualified individual or team, if approved by Sponsors and Administrator, and if both parties mutually commit to the exchange of responsibility in writing.

10. Other Things to Know

Entry Conditions and Release

By entering, Contestants agree to the following conditions and release:

(1) Each Contestant agrees to comply with and be bound by these Official Rules and the decisions of the Sponsors, Administrator, and/or the Competition judges which are binding and final in all matters relating to this Competition.

(2) Each Contestant also agrees to release and hold harmless the Sponsors, Administrator, and their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Competition, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability. These claims, expenses, and liability include, but are not limited to, negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a Contestant’s entry, creation of an entry or submission of an entry, participation in the Competition, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, transmission, performance, exploitation or use of entry.

(3) Each Contestant also agrees to indemnify, defend and hold harmless the Sponsors and Administrator from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to a Contestant’s participation in the Competition and/or Contestant’s acceptance, use or misuse of prize.

Publicity

Except where prohibited, participation in the Competition constitutes winners’ consent to Sponsors’, Administrator’s and their agents’ use of winner’s name, likeness, photograph, voice, opinions, hometown and state; application screenshots, app videos, app descriptions and commentary for promotional purposes in any media, worldwide, without further payment or consideration.

General Conditions

Sponsors and Administrator reserve the right to cancel, suspend and/or modify the Competition, or any part of it, if any fraud, technical failures or any other factor beyond Sponsors and/or Administrator’s reasonable control impairs the integrity or proper functioning of the Competition, as determined by Sponsors and/or Administrator in their sole discretion. Sponsors and/or Administrator reserve the right in their sole discretion to disqualify any individual or Competitor it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.

Any attempt by any person to deliberately undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors and/or Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Limitations of Liability

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Competition; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Competition; (4) technical or human error which may occur in the administration of the Competition or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use or misuse of any prize.

Any attempt by any person to deliberately undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors and/or Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors and/or Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Disputes

Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, other than those concerning the administration of the Competition or the determination of winners, shall be resolved individually, without resort to any form of class action; (2) any and all disputes, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate New York State Court; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Competition, but in no event attorneys’ fees; and (4) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsors, and Administrator in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
